Terms of Service

The most recent version of the General Austrian Forwarding Conditions (AÖSp) applies to forwarding services. In addition, the general terms and conditions of Welog GmbH & CO KG and Welog Reisinger GmbH apply.

1) This order is effective even without your confirmation.

2) All dates and deadlines must be strictly adhered to, as it is a matter of CMR term goods. You guarantee compliance with them.

3) By accepting the transport order, the carrier confirms that he has all the permits and authorizations required for the transport, in particular driving and commercial licenses as well as work permits for his drivers and that he has checked their driving authorizations (also for dangerous goods).

4) You have to take out CMR insurance for the transported goods according to Western standards with a sufficient sum insured at your own expense. After placing the order, you must automatically send us the CMR policy by fax or email, otherwise we reserve the right to deduct an amount of EUR 30 from your freight bill.

5) It is assumed that the contractor has taken out motor vehicle liability insurance for the vehicles he uses and, in the case of waste transport, also environmental liability insurance with the highest possible insurance sum of the respective registration country. The Contractor shall have unlimited liability for damage resulting from a lack of insurance cover. The client must be informed immediately of any changes.

6) You guarantee absolute customer protection and neutrality and undertake to refrain from offering or having offered the same or comparable services to our customers. Should we become aware of an infringement on your part, we are entitled not to pay for the transport carried out.

7) You must notify us immediately of any problems, obstacles to transport, damage, etc.

8) In the event of delays or other deviations from the agreed order, the customer must be informed immediately. The costs arising from non-compliance with this regulation shall be borne in full by the contractor.

9) Welog must be informed immediately
  • if the information in the bill of lading deviates from our transport order.
  • in the case of transport accidents or other breakdowns.
  • upon detection of damage to goods.
  • in official controls.
  • in the event of deviations from the usual transport process.
  • if it becomes apparent that specified deadlines cannot be met.
  • in the case of complaints and refusal of acceptance by the recipient.
  • if transport documents, dangerous goods sheets and customs documents are missing.
  • for all deviations from usual processes.
10) 24 hours for both loading and unloading are free of demurrage. In addition, you are only entitled to demurrage if we are at least responsible for the downtime with gross negligence.

11) It is agreed that our truck may spend its driving and rest times in public parking lots as well as company parking lots. If the type of goods requires a guarded parking lot, for example, our dispatcher must be expressly informed of this separately. A mere note in the small print of the transport order is not considered agreed.

12) Only confirmed CMR bills of lading or delivery notes that also state the exchange of loading equipment will be accepted.

13) Exchange of loading equipment: The procedure for exchanging loading equipment (e.g. Euro pallets) is an important part of this order and the carrier is solely responsible for clearly documenting the movements of loading equipment at the loading and unloading point. He also bears the sole risk of non-exchange at the recipient. If an exchange of loading equipment has been agreed and is not adhered to, the costs charged to us will be passed on in full to the carrier. If loading equipment has been exchanged, the freight invoice must also include the original loading equipment slip. Pallet notes brought later cannot be accepted after a period of 2 months. The client assumes no responsibility for the acceptance of one-way pallets exchanged by mistake or damaged pallets. The carrier is responsible for checking the correct loading.

14) Your drivers are obliged to check the weight, the number of items and the packaging of the transported goods. Any loading or reloading is not permitted without our approval. You are liable for operational and transport-safe loading and securing of the goods to be transported. You must carry sufficient load securing equipment with you. Your drivers are also obliged to ensure that the loading equipment is secured in accordance with the transport order, that the loading area is cleaned as required and that the load is not damaged.
Billing and payment conditions

15) The original CMR waybill or delivery note with acceptance confirmation from the recipient must be submitted with your freight invoice. The freight papers must reach us within 14 days after the freight has been carried out, otherwise a freight deduction of 20% will be made.
